Terms and Conditions

These terms and conditions govern the bin cleaning services provided by rinse bin cleaning. In Alberta, services are provided by INSIGHT BIN SOLUTIONS (CALGARY) INC.; in Ontario, services are provided by RINSE BIN CLEANING (KW) INC. (each referred to in these terms as the "Company," "Rinse," "we," or "us"). By entering into a service agreement with us, and by using our website and services, you agree to be bound by these terms and conditions.

1. Services We Provide

Rinse provides cleaning of up to three (3) household waste bins — typically one (1) each for garbage, recycling, and organic waste — according to the schedule set out in your service agreement, during the months of March, April, May, June, July, August, September, and October. Cleaning dates follow your municipal waste pickup schedule and take place after municipal waste pickup has occurred.

The Company's only obligation under your service agreement is to provide the cleaning services as outlined and in accordance with these terms and conditions.

2. Your Responsibilities

You agree to receive and pay for the service outlined in your service agreement, to make your premises and bins available to the Company so that it can perform the service, and to contain your pets during service visits.

3. Limitation of Liability

The Company is not liable for any actual or consequential damages to your property or its contents. The Company is not liable for any form of repairs to buildings or their contents. The Company is not liable for any injury or damages resulting from the service provided.

Nothing in these terms excludes or limits the Company's liability for damages resulting from its negligence where such exclusion is not permitted by law.

4. Cancellation

To discontinue service, you agree to speak with a member of Rinse's customer service team, either by calling our offices or by visiting one of our local branch offices, and to do so no less than 30 days before your next scheduled service.

If you cancel within the 10-day cooling-off period, you are entitled to a full refund for all services not yet rendered and will not be charged an early-termination fee. Cancelling before the completion of your Initial Service Commitment, once the 10-day cancellation period has elapsed, will require you to pay an early-termination fee as set out in your service agreement. This fee represents a reasonable estimate of the Company's administrative costs, scheduling costs, and losses resulting from early termination.

There is no charge to discontinue service after your Initial Service Commitment has elapsed. Should you refuse service either upon the arrival of the service technician or less than 30 days before your next scheduled visit, once the initial service has already been performed and the 10-day cancellation period has elapsed, you agree to pay the agreed-upon cost of the service visit in question.

There is no charge to cancel your service agreement before the initial service has been performed, nor to discontinue service after the Initial Service Commitment has elapsed. Nothing in these terms restricts your right to cancel by any method permitted under applicable law.

5. Schedule of Service

The Company will service your premises according to the schedule set out in your service agreement, during the months indicated in that agreement. The Company reserves the right to change the service schedule if it becomes necessary, and will advise you should this occur.

6. Circumstances Beyond Our Control

The Company's obligations under your service agreement will be suspended or terminated if the Company is prevented from fulfilling them by reason of transportation shortages, shortages of fuel or materials, strikes, embargoes, fire, floods, quarantine restrictions, natural disasters, or any other act of God or circumstance beyond the Company's control.

7. Price Changes

The price of the service may increase over time due to the increased cost of maintaining the high quality of service you expect from Rinse. There will be no increase in price during your Initial Service Commitment term.

If the Company increases the price of service after your Initial Service Commitment term, it will send you written notice at least 30 days before the increase takes effect, setting out the new price and its effective date. You may refuse the price increase and cancel your service agreement without cost, penalty, or cancellation indemnity by sending the Company a notice to that effect no later than 30 days after the price increase takes effect.

8. Communications Consent

By providing your email address(es) and phone number(s), you authorize Rinse to contact you by phone and email regarding upcoming services, invoices, service reports, outstanding balances, and promotional offers or complimentary service offerings. Text-message communications are sent only in accordance with the SMS opt-in selections you make: service-related texts require selecting the optional customer care/service-related SMS checkbox, and promotional or marketing texts require selecting the optional marketing SMS checkbox, each as described in the SMS Messaging Terms below. You may opt out of email or text notifications at any time by contacting Rinse and making the request.

Your Right to Cancel — Alberta

The following statutory cancellation rights apply to customers in Alberta, under the Alberta Consumer Protection Act.

You may cancel this contract from the day you enter into the contract until 10 days after you receive a copy of the contract. You do not need a reason to cancel.

If you do not receive the goods or services within 30 days of the date stated in the contract, you may cancel this contract within one year of the contract date. You lose that right if you accept delivery after the 30 days. There are other grounds for extended cancellation. For more information, you may contact your provincial/territorial consumer affairs office.

If you cancel this contract, the seller has 15 days to refund your money and any trade-in, or the cash value of the trade-in. You must then return the goods.

To cancel, you must give notice of cancellation at the address in your service agreement. You must give notice of cancellation by a method that will allow you to prove that you gave notice, including registered mail, fax, or personal delivery.

Your Right to Cancel — Ontario

The following statutory cancellation rights apply to customers in Ontario, under the Consumer Protection Act, 2002.

You may cancel this agreement at any time during the period that ends ten (10) days after the day you receive a written copy of the agreement. You do not need to give the supplier a reason for cancelling during this 10-day period.

If the supplier does not make delivery within 30 days after the delivery date specified in this agreement or if the supplier does not begin performance of his, her or its obligations within 30 days after the commencement date specified in this agreement, you may cancel this agreement at any time before delivery or commencement of performance. You lose the right to cancel if, after the 30-day period has expired, you agree to accept delivery or authorize commencement of performance.

If the delivery date or commencement date is not specified in this agreement and the supplier does not deliver or commence performance within 30 days after the date this agreement is entered into, you may cancel this agreement at any time before delivery or commencement of performance. You lose the right to cancel if, after the 30-day period has expired, you agree to accept delivery or authorize commencement of performance.

In addition, there are other grounds that allow you to cancel this agreement. You may also have other rights, duties and remedies at law. For more information, you may contact the Ministry of Government and Consumer Services.

To cancel this agreement, you must give notice of cancellation to the supplier, at the address set out in the agreement, by any means that allows you to prove the date on which you gave notice. If no address is set out in the agreement, use any address of the supplier that is on record with the Government of Ontario or the Government of Canada or is known by you.

If you cancel this agreement, the supplier has fifteen (15) days to refund any payment you have made and return to you all goods delivered under a trade-in arrangement (or refund an amount equal to the trade-in allowance).

However, if you cancel this agreement after having solicited the goods or services from the supplier and having requested that delivery be made or performance be commenced within ten (10) days after the date this agreement is entered into, the supplier is entitled to reasonable compensation for the goods and services that you received before the earlier of the 11th day after the date this agreement was entered into and the date on which you gave notice of cancellation to the supplier, except goods that can be repossessed by or returned to the supplier.

SMS Messaging Terms

By selecting the optional customer care/service-related SMS checkbox, you consent to receive quote follow-ups, appointment reminders, service notices, account or service updates, and responses to your inquiry from rinse bin cleaning at the number provided. By selecting the optional marketing SMS checkbox, you consent to receive promotional offers, seasonal reminders, discounts, and other marketing messages from rinse bin cleaning at the number provided.

You may opt into either SMS category, both categories, or neither category. Consent to receive text messages is not a condition of purchase. Message frequency varies. Standard message and data rates may apply.
